This website is operated by FunDom (“FunDom,” “we,” “us,” or “our”). By accessing or using fundom.com (the “Site”), including purchasing any products, you agree to be bound by these Terms of Service (“Terms”) and any additional policies referenced here (including our Return Policy and Privacy Policy).

If you do not agree to these Terms, you may not access the Site or use any services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell products and services to you.

1. ONLINE STORE TERMS

  • You represent that you are at least the age of majority in your state or province of residence, or you have permission to use the Site under the supervision of a parent/guardian.
  • You may not use our products or the Site for any illegal or unauthorized purpose, and you may not violate any laws in your jurisdiction (including copyright laws).
  • You must not transmit any worms, viruses, or destructive code.
  • Violation of these Terms may result in termination of access to the Site and/or services.

2. GENERAL CONDITIONS

  • We reserve the right to refuse service to anyone for any reason at any time, to the fullest extent permitted by law.
  • Content you submit (excluding payment information) may be transferred unencrypted over various networks. Payment information is encrypted and processed by Shopify and its payment partners.
  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

3. ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We try to keep product information accurate, but we do not guarantee that all content on the Site is error-free, complete, or current. Information is provided for general purposes and may change without notice.

4. MODIFICATIONS TO THE SERVICE & PRICES

  • Prices, promotions, and product availability are subject to change without notice.
  • We may modify or discontinue the Site or any portion of the Service at any time.

5. PRODUCTS, AVAILABILITY & ORDER LIMITS

  • Certain products may be available exclusively online and may have limited quantities.
  • We reserve the right to limit sales by person, household, account, payment method, or shipping address.
  • We reserve the right to cancel orders that appear to be placed by resellers, dealers, or distributors, or that pose fraud risk.
  • We make reasonable efforts to display product images and colors accurately, but we cannot guarantee your device will display colors the same way.

Collectibles & packaging-sensitive items: Many items we sell are collectibles. Minor factory variations, paint variation, or light packaging wear from transit/manufacturing may occur and may not qualify as damage. Please review product listings and our Return Policy for details.

6. PRE-ORDERS, BACKORDERS & MADE-TO-ORDER (IF APPLICABLE)

Some items may be offered as pre-orders, backorders, or made-to-order items. Estimated ship dates are provided as best estimates and may change due to manufacturer or logistics delays.

  • Pre-orders and made-to-order items may have special cancellation/return restrictions as described on the product page and/or our Purchase Options / Cancellation Policy.
  • If a manufacturer cancels an item or we are unable to fulfill, we will issue a refund to the original payment method (or offer store credit where permitted and agreed).

7. ACCURACY OF BILLING & ACCOUNT INFORMATION

  • You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.
  • You agree to promptly update your account information (including email address and payment details) so we can complete transactions and contact you if needed.

We reserve the right to refuse or cancel any order. If we cancel an order, we may attempt to notify you via the email and/or phone number provided at checkout.

8. SHIPPING, DELIVERY & RISK OF LOSS

  • Shipping and delivery timelines shown at checkout are estimates and not guarantees.
  • Once a package is transferred to the carrier and marked as shipped, carrier delays are outside our control.
  • Risk of loss transfers to the customer upon delivery to the shipping carrier to the extent permitted by law. If a shipment shows delivery but you did not receive it, contact us promptly so we can assist with a carrier investigation.

9. RETURNS, REFUNDS & EXCHANGES

Returns, refunds, and exchanges are governed by our Return Policy. Certain items may be final sale and non-returnable. By placing an order, you acknowledge you have reviewed and agree to our return terms.

10. THIRD-PARTY TOOLS & LINKS

We may provide access to third-party tools or links that we do not control. Any use of third-party tools or sites is at your own risk and subject to the third party’s terms and policies.

11. USER COMMENTS, FEEDBACK & SUBMISSIONS

If you send us suggestions, reviews, or other content (“Submissions”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and distribute the Submission for business purposes (such as marketing or product pages), unless prohibited by law.

You agree that your Submissions will not violate any third-party rights and will not include unlawful, abusive, or malicious content.

12. INTELLECTUAL PROPERTY

All Site content (including text, graphics, logos, images, product photography, and layout) is owned by FunDom or used under license and is protected by intellectual property laws.

Brand names and characters: Product names, brand names, and character names are used to identify authentic merchandise and are the property of their respective owners. FunDom is not affiliated with or endorsed by rights holders unless expressly stated.

13. PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

14. ERRORS, INACCURACIES & OMISSIONS

We reserve the right to correct errors or inaccuracies and to update information or cancel orders if any information is inaccurate at any time, including after an order is submitted.

15. PROHIBITED USES

You are prohibited from using the Site or its content for unlawful purposes, to infringe intellectual property, to harass or abuse others, to submit false information, to distribute malware, to scrape or harvest data, or to interfere with the Site’s security or operation. We may terminate access for violations.

16. DISCLAIMER OF WARRANTIES

The Site, service, and all products are provided “as is” and “as available,” except as expressly stated by us. We do not guarantee uninterrupted, timely, secure, or error-free operation of the Site.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, FunDom and its officers, employees, affiliates, agents, suppliers, and service providers will not be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the Site or purchase of products, including lost profits, lost revenue, loss of data, or replacement costs.

In jurisdictions that do not allow certain limitations, our liability will be limited to the maximum extent permitted by applicable law.

18. INDEMNIFICATION

You agree to indemnify and hold harmless FunDom and its affiliates, officers, employees, and service providers from claims arising out of your breach of these Terms or violation of any law or third-party rights.

19. SEVERABILITY

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.

These Terms remain effective unless terminated by you or us. We may terminate or suspend access to the Site at any time if we believe you have violated these Terms.

These Terms are governed by and construed in accordance with the laws of the United States and the state in which FunDom is established, without regard to conflict of law principles.

We may update these Terms from time to time. Updates will be posted on this page. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
